Conflict of Interest (HB 914) is the bill enacted disclosure requirement that applies to certain school district officials and their family members who have received gifts from vendors.  Please refer to Chapter 176, Local Government Code for more information.  Visit Texas Ethic Commission for both Conflict of Interest and Conflict of Interest Questionnaire forms.
For contracts entered into on or after January 1, 2016, Texas Government Code Chapter §2252.908 (H.B. 1295) provides that a Texas governmental entity or state agency may not enter into a contract that either (1) requires an action or vote by the governing body of the entity or agency or (2) has a value of at least $1 million, unless the business entity submits a disclosure of interested parties to the governmental entity or state agency. The Texas Ethics Commission (Commission) has adopted a certificate of interested parties form (Form 1295) and adopted rules requiring the business entity to file Form 1295 electronically with the Commission. The Regional Purchasing Cooperative (RPC) and the Purchasing Cooperative of America (PCA) are not a business entity under this law (see 1 Tex. Admin. Code 46.3(b). However, RPC/PCA vendors may be business entities and may, for certain purchases and contracts from RPC/PCA members, be required to file disclosures under Texas Government Code Chapter 2252. It is the responsibility of vendors to determine the applicability of, and comply with, all disclosure laws including Chapter 2252. Disclosure will not be handled by RPC/PCA administration.

The Service Center and/or the Cooperative will consider the following factors in determining whom to award a contract: costs; reputation of vendor and vendor's goods and services; quality of vendor's goods or services; extent to which goods or services meet Service Center's and/or the Cooperative's needs; vendor's past relationship with the Service Center and/or the Cooperative; impact on ability of the Service Center and/or the Cooperative to comply with laws and rules relating to historically underutilized businesses; long term cost to the Service Center and/or the Cooperative to acquire vendor's goods or services; and any other relevant factor specifically listed in the request for proposals.

The Service Center and/or the Cooperative reserves the right to reject any and/or all proposals and to accept any proposal deemed by the Service Center and/or the Cooperative as being most beneficial to the Service Center and/or the Cooperative, and to waive all formalities in requesting proposals.

While these contracts to be awarded are national in nature, Region III ESC/PCA encourages local vendors to respond in order to continue providing services to the 40 school districts in the Region III ESC service area in and around Victoria, Texas.  Other local vendors in states other than Texas are encouraged to respond so they can work with their local PCA Members.  In TAB 7 Vendor Questionnaire and Company Profile, vendors will be asked to choose the states, territories, NAFTA and Texas Education Service Centers that they would like to work with when responding to the solicitation(s).
